Introduction
Welcome to Qalyup! These Terms and Conditions ("Terms") govern your access to and use of the Qalyup website and services. Qalyup is a UK-based platform that connects users (patients) with high-quality healthcare providers in different countries. Please read these Terms carefully before using our platform. By accessing or using Qalyup, you agree to be bound by these Terms. If you do not agree, please do not use our platform.
This document explains what you can expect from us and what we expect from you when you use Qalyup. It also outlines important legal details like your rights and responsibilities. These Terms are written to comply with UK law and include provisions to meet General Data Protection Regulation (GDPR) standards.
Definitions
For clarity, here are some key terms we use in this document:

"Qalyup", "we", "us" or "our": Refers to Qalyup Ltd, the company providing the platform (including our website and related services).

"Platform": The Qalyup website (qalyup.com) and any Qalyup mobile applications or online services that facilitate connecting users with healthcare providers.

"User" or "you": Any person who uses the Qalyup platform. This includes patients or prospective patients who are seeking healthcare services through Qalyup.

"Healthcare Provider" or "Provider": A third-party clinic, hospital, doctor, dentist, or other medical professional or facility that offers medical or healthcare services and has partnered with Qalyup.

"Services": The services provided by Qalyup, including connecting users with Providers, providing information, facilitating bookings for medical treatments, and assisting with related arrangements such as travel coordination.

"Booking": A reservation or appointment made through Qalyup for a healthcare service with a Provider.

"Deposit": An advance payment (generally 7.5% of the treatment cost, with a minimum cap of £50 and a maximum cap of £250) required to secure a Booking.

"Agreement": Refers to these Terms and Conditions as a binding agreement between you and Qalyup when you use the platform.
Eligibility
You must be at least 18 years old to use Qalyup. By registering or using our Services, you confirm that you are 18 or older. The platform is not intended for use by minors. If you are under 18, you are not permitted to create an account or use Qalyup for any purpose.
You also represent that any information you provide to us is truthful and accurate, and that you have the legal capacity to enter into this Agreement. Using Qalyup from certain jurisdictions may not be allowed if prohibited by local rules – it is your responsibility to ensure you are legally allowed to use our platform.
User Accounts
To use certain features of Qalyup (such as requesting quotes or making a Booking), you may need to create a user account. When you create an account, you agree to the following:

Provide Accurate Information: You must provide true, current, and complete information about yourself (including medical information relevant to your requested treatment). Keep your information updated if it changes.

Account Security: You are responsible for keeping your account credentials (username and password) confidential and secure. Do not share your password with anyone. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or any breach of security, notify us immediately.

Personal Use Only: Your account is for your personal use. You must not transfer your account to others or use it to impersonate anyone.

Compliance with Laws: You agree to use our platform and Services only for lawful purposes. Do not use Qalyup to engage in any fraudulent, harmful, or illegal activity. We reserve the right to suspend or terminate your account if we suspect misuse.
Services Provided by Qalyup
Qalyup is a facilitator that helps you find and connect with healthcare providers abroad. It is important to understand what Qalyup does and does not do:

Facilitator Role: Qalyup’s role is to introduce users to high-quality partner clinics and hospitals and to help coordinate the logistics of obtaining treatment. We act only as an intermediary between you and the Healthcare Provider.

No Medical Services by Qalyup: Qalyup is not a healthcare provider and does not practice medicine. We do not give medical advice or treatment. Any medical care you receive is provided solely by the independent Healthcare Provider with whom you book. Qalyup is not responsible for the medical treatment provided by partner clinics or providers, and we do not guarantee any particular outcome of any treatment.

Information and Estimates: On your request, Qalyup may assist in obtaining an initial estimate, quote, or treatment plan from a Provider based on the medical information you submit. This service is for your convenience to help you make an informed decision. However, this initial quote or plan is not a definitive medical diagnosis or a guarantee of treatment. The Provider may need to adjust the treatment plan or cost after further diagnostics or a face-to-face consultation with you. Qalyup is not responsible for changes to your treatment or costs that occur after the Provider conducts their own evaluation or additional tests.

Quality of Providers: We strive to partner with reputable, high-quality Healthcare Providers. While we may perform initial vetting (for example, ensuring the Provider is licensed, has good reviews and onsite inspections), Qalyup does not control or supervise the medical procedures. We cannot warrant or guarantee the quality, safety, or suitability of any medical treatment performed by the Provider. Choosing to undergo treatment with a Provider is at your discretion and risk.

Independent Providers: When you book a treatment through Qalyup, you are entering into a separate agreement with the Provider for your medical services. Qalyup is not a party to that treatment contract. The Provider will have their own terms of service or patient consent forms you may need to agree to. Qalyup will not be responsible for any acts, omissions, or negligence of the Provider.
Medical Disclaimer
All information provided on the Qalyup platform (including articles, provider information, quotes, and treatment plans) is for general informational purposes and for facilitating services only. It is not medical advice. Qalyup does not provide medical advice, diagnoses, or treatment recommendations. Any content you read on our site or any communications from Qalyup staff should not be considered a substitute for professional medical advice from a qualified doctor.
Always consult with a licensed healthcare professional for advice about your own health or medical treatment. Any decisions you make regarding medical care should be made in consultation with your healthcare provider. If you have a medical emergency, you should call emergency services or contact a doctor immediately; do not rely on our platform for urgent medical needs.
Qalyup does not endorse or recommend any specific Provider or treatment. While we provide you with options and information, you should evaluate the information and make your own decision about which healthcare provider to use and what treatment to undergo.
Booking & Payment Terms
When you decide to proceed with a treatment through Qalyup, the following booking and payment terms apply:

Booking Confirmation and Deposit: To confirm a Booking with a healthcare Provider, you will typically be required to pay a deposit equal to 10% of the estimated treatment cost (with a maximum deposit of £250, even if 10% of the cost would be higher).

Payment Process: Qalyup will inform you of the deposit amount and collect this payment through our platform at the time of booking. The deposit will be credited toward the total cost of your treatment. The remaining balance for the treatment (beyond the deposit) is generally paid directly to the Provider according to the Provider’s payment terms (often on the day of treatment or as otherwise instructed by the Provider).

Non-Refundable Deposit: The deposit is non-refundable in most cases. This means if you decide to cancel the treatment or do not show up to your appointment, you will not get the deposit back. The deposit covers administrative costs.

Exception – Provider-Initiated Changes: If the healthcare Provider cancels your appointment, significantly changes the scope of the service, or is unable to perform the service as originally agreed, Qalyup will work with you to find an alternative solution. If the Provider or Qalyup proposes a change in the service (for example, a different clinic, a different treatment, or a different date) and you do not find the alternative acceptable, you will be entitled to a refund of the deposit. In short, your deposit will be refunded if the service provider changes the service and no acceptable alternative can be arranged for you. If you do accept an alternative Provider or revised service, the deposit you paid will typically be applied to that new booking instead.

Pricing Accuracy: We try to ensure that all prices and cost estimates provided on our platform are accurate and up-to-date. However, final costs can vary based on your actual medical condition and any additional tests or treatments that were not evident from your initial information. The Provider will inform you of any changes to pricing before proceeding with any additional or altered treatment. Qalyup is not responsible for any price differences arising from changes in your treatment plan after further examination by the Provider.
Cancellations and Refunds
We understand that plans can change. This section explains how cancellations and refunds are handled:

User Cancellations: If you decide to cancel your booking, please notify Qalyup as soon as possible. Keep in mind that, as noted above, your deposit is non-refundable except in the special circumstances described. Cancelling your appointment will generally result in you losing your deposit. We recommend only confirming a booking if you are serious about going through with the treatment.

Rescheduling Appointments: If you need to change the date of your appointment, you may reschedule by giving at least 15 days’ notice before your originally scheduled treatment date. Rescheduling is subject to the Provider’s availability and agreement. There is no penalty or fee for rescheduling if you give at least 15 days’ notice. However, if you request a reschedule on short notice (less than 15 days before the appointment), it may be treated as a cancellation, and the deposit might be forfeited (unless otherwise agreed). We will do our best to assist, but we cannot guarantee that late rescheduling will be possible.

Provider Cancellations or Changes: In rare cases, a Provider might need to cancel or significantly change your appointment (e.g., due to a medical team issue or an unforeseen circumstance). If that happens, Qalyup will inform you as soon as possible and help you reschedule or find a comparable Provider. If the Provider’s cancellation or change means the original service cannot be provided and you choose not to proceed with an alternative, you will receive a full refund of any deposit or payment you have made for that booking.

Refund Process: If you are entitled to a refund (for example, in the case of a Provider-initiated change that you reject), Qalyup will process that refund to the original payment method you used. Refunds will be processed as soon as practicable, typically within 14 days of confirming your eligibility for a refund. Please note that your bank or card issuer might take additional time to post the refunded amount to your account.

Travel Cancellations: If you have arranged travel services (flights, hotels, etc.) through third parties in connection with your treatment, you will need to manage cancellations or changes to those reservations according to the terms of the travel providers. Qalyup is not responsible for any travel-related cancellations or costs (see Travel Arrangements below for more details).
Travel Arrangements
Travel and accommodation may be a part of your healthcare journey, especially if you are traveling abroad for treatment:

Third-Party Travel Services: Qalyup may assist you by suggesting or facilitating introductions to third-party travel providers (such as airlines, hotels, or travel agencies) to help with flights, accommodation, or transportation. However, any travel booking you make is subject to the travel provider’s own terms and conditions. For example, if you book a flight or hotel recommended by Qalyup, the airline’s or hotel’s contract (including cancellation policies, baggage rules, etc.) will apply to that booking.

No Qalyup Liability for Travel: Qalyup does not operate or control any travel services. We are not responsible for issues such as flight delays, cancellations, lost luggage, hotel problems, or any other travel complications. Any issues with travel must be resolved between you and the travel provider. Be sure to read and understand the terms provided by the airline, hotel, or other travel service.

Travel Documents and Insurance: You are responsible for obtaining all necessary travel documents and meeting any requirements for travel. This includes having a valid passport, any required visas, and any necessary vaccinations or medical clearances to travel or receive treatment in the destination country. We strongly recommend that you purchase appropriate travel insurance that covers medical travel, in case you need to cancel your trip or if any issues arise while abroad.

Coordination with Treatment Schedule: It is your responsibility to schedule your travel so that you arrive in time for your medical appointments. Qalyup and the Provider will give you a schedule for your treatment; you should plan your flights and other travel arrangements accordingly. If your travel plans change or you experience delays that impact your ability to attend your medical appointment, inform Qalyup and the Provider immediately. We will try to help accommodate changes, but neither Qalyup nor the Provider is obliged to reschedule on short notice due to travel delays.

Package Services: Unless explicitly stated, any travel services are separate from Qalyup’s healthcare facilitation service. Qalyup does not sell combined travel and medical treatment packages; we facilitate medical bookings and may provide referrals for travel, but we do not bundle these into a single contract. This means each service (medical treatment, flight, hotel) is governed by its own terms.
Data Protection & Privacy (GDPR Compliance)
Your privacy is very important to us. Qalyup is committed to protecting your personal data and using it only in line with applicable data protection laws, including the UK’s Data Protection Act 2018 and the General Data Protection Regulation (GDPR). Here are the key points regarding how we handle your data:

Personal Data Collection: When you use Qalyup, we will collect personal information from you, such as your name, contact details, and relevant medical information needed to connect you with a Provider and arrange your treatment. We collect only what is necessary for providing our Services.

Use of Your Data: We use your personal data to facilitate the Services you request – for example, to create your account, to match you with suitable healthcare Providers, to communicate with you about quotes or bookings, and to coordinate your appointments. We may also use your email to send you updates or information about our services, but you can opt out of marketing communications if you prefer.

Sharing Data with Providers: In order to get you an accurate quote or to book your chosen treatment, we will share relevant information you provide with the healthcare Provider (or Providers) that you are interested in. For instance, if you request a dental treatment quote, we will share your dental records or X-rays (if you provided them) with the potential clinic. We will not share your personal data with any third parties except as necessary to provide our Services or as required by law. We will never sell or rent your personal data to any unrelated third party.

International Data Transfers: Because Qalyup connects you with healthcare providers in different countries, your personal data (including sensitive health information) might be transferred to and processed in countries outside of the UK (or outside the European Economic Area) where privacy laws may be less strict. We will only do this to the extent necessary for the service (for example, sending your medical information to a clinic abroad that you are considering). Whenever we transfer data internationally, we will take steps to ensure your data is protected in line with UK GDPR requirements, such as using standard contractual clauses or obtaining your explicit consent where required.

Data Security: We implement appropriate technical and organisational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmitting or storing data is completely secure, so we cannot guarantee absolute security. It is important that you also keep your account information secure (see User Accounts above regarding your responsibilities).

Your Rights: Under GDPR, you have several rights regarding your personal data. These include the right to access the data we hold about you, the right to correct any inaccuracies, the right to have your data deleted or “forgotten” (when it’s no longer needed for the purposes you agreed to or if you withdraw consent), and the right to object to or restrict our processing of your data. You also have the right to data portability (to get your data in a common format) and the right not to be subject to significant decisions based solely on automated processing. Privacy Policy: These Terms include a summary of our privacy and data practices, but we may provide a more detailed Privacy Policy available on our website. Limitation of Liability
This section limits the liability of Qalyup to you, as permitted by law:

No Liability for Medical Outcomes: Because Qalyup is not the medical provider and has no control over your actual treatment, we are not liable for any injury, loss, or damages that result from any medical procedures or treatments you receive through a Provider. Any issues or complications from the medical treatment are a matter between you and the Provider under their own patient agreement.

Platform Provided “As Is”: Qalyup strives to provide a reliable service, but we do not make any specific promises about the platform. The website and all services are provided to you on an “as is” and “as available” basis without warranties of any kind. This means we don’t guarantee that the content on our site is error-free, that the platform will always be available or secure, or that it will meet your needs. To the fullest extent permitted by law, we disclaim any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

Indirect or Consequential Damages: In no event will Qalyup or its affiliates be liable for any indirect, special, incidental, or consequential damages. This includes, but is not limited to, loss of profits, loss of business, loss of goodwill, loss of data, or other intangible losses that may result from using (or inability to use) our platform or services, even if we have been advised of the possibility of such damages.

Liability Cap: If we are found liable for any claim arising out of or relating to our services, our liability to you shall be limited to the amount of fees you paid to Qalyup for the service in question (for example, the deposit you paid for a booking). This limitation does not affect any refund you are entitled to as described in the Cancellations and Refunds section, which we will process as agreed.

No Liability for Third Parties: Qalyup is not responsible for the acts or omissions of third parties. This includes the Healthcare Providers (who are not employees or agents of Qalyup) and any travel or logistics providers. We provide the platform and introductions, but each Provider is independent and has sole responsibility for the care they provide. Similarly, any travel arrangements are between you and the travel company. We have no liability for any breach of contract or negligence by any third party you connect with through Qalyup.

No Exclusion for Mandatory Liability: Nothing in these Terms excludes or limits liability that cannot be excluded by law. In particular, we do not exclude or limit our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that under UK law cannot be limited or excluded. Additionally, these Terms do not affect any rights you have under consumer protection laws that cannot be waived or limited by contract.
Intellectual Property
All content and materials on the Qalyup website and platform are protected by intellectual property laws:

Ownership of Content: Unless otherwise stated, all materials on the site – including text, data, graphics, logos, button icons, images, audio clips, software, and design elements – are property of Qalyup Ltd or its content suppliers. This content is protected by copyright laws, trademarks, and other intellectual property rights. Qalyup and its suppliers retain all rights, title, and interest in this content.

Permitted Use: You may access and use the website content solely for your personal, non-commercial use in connection with seeking healthcare information or services through Qalyup. For example, you may display pages on your screen, download or print a copy of portions of the content for your personal use.

Prohibited Use: You must not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from our website for any other purpose without our prior written consent. You also may not create derivative works from the site content. Using any Qalyup content on any other website or networked computer environment (for example, republishing our clinic listings or articles on another site) without permission is a violation of these Terms.

Trademarks: The name “Qalyup”, our logo, and any other Qalyup product or service names or slogans that appear on the platform are trademarks of Qalyup Ltd. Other marks, logos, and names that appear on the platform may be trademarks of third-party partners (such as the healthcare providers or travel companies). You are not granted any rights or license to use any trademarks or logos through these Terms. Unauthorized use of any trademark displayed on Qalyup is prohibited.

User Content: If our platform allows you to submit reviews, comments, or other content (for instance, feedback about a clinic), you retain ownership of your content, but by submitting it, you grant Qalyup a license to use, display, and distribute that content for the operation of our services. (Currently, our platform’s main use of user-provided content is the personal information you give for bookings, which is handled as described in the Privacy section, and not publicly displayed.)

Reporting IP Issues: If you believe any content on our site infringes your copyright or other intellectual property rights, please contact us with details so we can investigate and remove or disable access to the infringing content if appropriate.
Governing Law and Jurisdiction
These Terms and any disputes arising out of or relating to them or the use of the Qalyup platform are governed by the laws of England and Wales (United Kingdom), without regard to its conflict of law principles. This means that the laws of England and Wales will apply to any issue or conflict involving these Terms.
If you are a consumer using our platform, you may also have rights under the consumer protection laws of your country of residence. We do not seek to limit any of those rights and will respect applicable consumer laws.
Jurisdiction: In the event of a dispute, you and Qalyup agree that the courts of England and Wales will have exclusive jurisdiction to resolve any legal proceedings relating to these Terms or your use of the Services. (If you are using Qalyup as a consumer from outside of England and Wales, you may also have the right to bring proceedings in your local courts under applicable law. But in all cases, English law will govern the substantive legal issues.)

Other Important Terms

It is your responsibility to review the Terms periodically. By continuing to use the platform after any changes come into effect, you are agreeing to the revised Terms.

Entire Agreement: These Terms (along with any other policies or documents expressly referred to within them, such as our Privacy Policy) represent the entire agreement between you and Qalyup regarding your use of our platform and services. They supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter.

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or regulator, that provision will be deemed removed (or adjusted to the minimum extent necessary to make it enforceable), but this will not affect the validity and enforceability of the remaining provisions, which will remain in full force and effect.

No Waiver: If we do not enforce a part of these Terms, or if we delay in enforcing it, that does not mean we are waiving our right to enforce it later. Any waiver of our rights or remedies under these Terms is only effective if it is in writing and signed by us.

Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may transfer our rights and obligations to another organization (for example, if we undergo a reorganization or merger); if we do so, we will ensure that your rights under these Terms are not prejudiced and we will notify you if required by law.

Third-Party Rights: These Terms are between you and Qalyup. Except for Qalyup’s affiliates, directors, employees, or the Providers (who to the extent applicable are protected by the liability limitations herein), no other person has any rights to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.

Termination: We reserve the right to suspend or terminate your access to Qalyup at any time if you violate these Terms or if we need to do so for security, legal, or operational reasons. If your account is terminated, these Terms will continue to apply to any matters arising from your use of the platform prior to termination.
